Declarations of new construction or expansion of existing constructions

Through the declaration of new construction, the owner of the land, a surface right, or another pre-existing construction, whether registered or not as a property in the Land Registry, declares in a public deed the fact of having projected, begun, or completed buildings, new floors, or improvements on them, with the purpose of documenting the acquisition title and, if legal requirements are met, registering this modification in the Land Registry, thus achieving a greater degree of legal security for the new construction.

We currently offer the service of signing for declarations of new construction or expansion of existing ones. The necessary documentation is as follows:

  • Ownership titles of the landowners.

  • National ID of the interested parties.

  • If a company is involved, the current powers or appointment of administrators.

  • Cadastral reference (latest IBI receipt).

  • Municipal building permit.

  • Technical project, indicating the budget for material execution.

  • Once granted, it is necessary to provide a certification from the architect who authored the project, confirming that the description contained in the deed matches the project for which the building permit was obtained.

Declarations of New Construction Without a Technical Project

We currently offer the service of signing for declarations of new construction without a technical project. The necessary documentation is as follows:

  • Ownership titles of the landowners.

  • National ID of the interested parties.

  • If a company is involved, the current powers or appointment of administrators.

  • Cadastral reference (latest IBI receipt).

  • Description of the building characteristics.

  • Municipal certificate of the existence of the building and its description, confirming that the new construction is not involved in any municipal disciplinary proceedings for urban planning violations.

  • Value assigned to the new construction being declared.

If a horizontal division is necessary: descriptions of each independent unit in the building, with their annexes.
